This includes, inter alia, the type and version of the web browser used, the website from which our site was linked, our websites visited and the date of the visit. All this is information, which does not allow the person to be identified. This information is not made available to third parties.
Usage of your personal data (title, first and last name, postal address, email address, telephone number, and payment information)is done in compliance with the European Data Protection Act in order to fulfil and process your order and to send messages by email in order, for example, to inform your of the status of orders. The wording of the contract and the order sent are also stored.
Your personal data, which you enter during the order, is only used for processing the contract. Some of your data (title, first and last name, address data, telephone number) will be made available to our logistics partners to facilitate delivery of your order. This forwarding is only ever performed in compliance with the strict requirements of the European Data Protection Act. There shall be no further forwarding of your information for purposes other than to fulfil, realise and terminate the contractual relationship between you and the artist, unless there is some statutory or official order to do so. The same shall apply to personal data you may have provided when contacting the artist in electronic or printed form.
−Terms and Conditions−
The following General Terms and Conditions in their most current version at the time of order shall exclusively govern the business relationship between Bogdan-Mihai Dragot, here acting under the artist's name and the orderer. Bogdan-Mihai shall not recognise any differing terms set out by the orderer unless such conditions have been expressly agreed to by Bogdan-Mihai in writing.
The display of the photographic artorks on the website does not constitute a legally binding offer; it is a non-binding online portofolio only. The photographic artworks you asked for are summarised and you can review the various information provided during the acquiring process. Directly after sending your order request you will receive an email with an order and contract conformation, in which the details of your order are listed again. The text of your request and order are saved by the artist and upon request can be sent to you after completion of your order. For your own protection, the artist recommends printing out the order details and the Legal Infos applicable at the time of order. The contractual languages are English and French.
Please note that sales are final for any photographic artworks as these pieces are produced with unique specifications. Should you cancel the sale contract, we are to refund all payments received from you, including shipping costs (with the exception of additional costs from selecting a different type of delivery than the standard, cost-effective shipping we offer) promptly - at the latest, within 14 days of our receipt of the statement indicating your cancellation. Refunds will be credited back to the original payment method, unless otherwise expressly agreed upon. We can withhold the refund until such time as we have received the returned goods or until you have provided proof of their return shipment, whichever comes first. You are to promptly send the goods back; at the very latest, this must be done within 14 days of the days you inform us of the cancellation. This deadline is met as long as the return shipment of goods is sent out within the allotted period. For orders from the EU and Switzerland, we shall bear the costs for returning goods. For orders from all other countries, you shall bear the direct costs for returning goods. Typically, goods cannot be returned by normal post. Please contact the artist for more information.You are only responsible for decreases in the value of goods if, after inspecting their condition, properties, and functionality, the decrease in value can be traced back to your improper handling of the goods. To exercise your right to cancel, you must inform the artist of your decision to cancel in a clear, written statement (by letter or e-mail for instance). You may use the cancellation form the artist provides to you by your request, but are not required to do so.
No granting of rights: by buying a photographic artwork, you are acquiring material ownership of the print. No other rights are granted or implied. Any reproduction (copying), dissemination, leasing, public exhibition or other analogue or digital use is not permitted unless authorised by law or expressely by the artist. However, you can resell the print.
Retention of title: until full and final payment, the sold artworks shall remain the property of the artist.
Edition of the Certificate with signature : the Edition Certificate with the artist’s signature and the edition details are delivered by the artist with the artwork. If you exercise your right of cancellation, you must also immediately return the unused Edition Certificate. In case of cancellation , the purchase price shall not be refunded without receipt of Edition Certificate. The right of cancellation shall lapse if the Edition Certificate is used on the work of art, the frame, the lamination or elsewhere. The terms and conditions have been drafted to regulate the business relationship between you and the artist and are intended to be both binding and fair. The basis for any order or contract will therefore always be the terms and conditions mentioned by the artist and you acknowledge and confirm you are aware of them and agree to their application when you place an order with the artist.
